New Student Assignment

The following books will be needed for the assignment. All are on closed or open reserve in the Evergreen Library, and the law books are available in the Evergreen bookstore:


Legal Research: How to Find & Understand the Law , by Stephen Elias, Susan Levinkind, Richard Stim. Nolo Press, 12th edition, 2004
Understanding Labor Law (Legal Text Series), by Douglas E. Ray, William Sharpe, Robert N. Strassfeld Matthew Bender & Company, 1999
Volume II of Who Built America?, Rosenzweig et al, Chapters 7 and 8, The Great Depression and the First New Deal, and Labor Democratizes America , pages 317-423.

1. Read chapters 7 and 8 of Who Built America? The Great Depression and the First New Deal, and Labor Democratizes America , pages 317-423. Write a two-page, double-spaced essay on the following question: What were the major legal changes that happened during the 1930s? How did workers' actions affect these changes? Do you agree with the book's editors that "labor democratized America" during these years? Why or why not? How or how not? (3-4 hours)
2. Read Chapters 1 and 3 of Understanding Labor Law. Keep notes. (2-3 hours)
3. Read chapters 7, 8, and 9 of Legal Research. (3 hours)
4. Find, read, and write about the Supreme Court's Emporium Capwell case. The Legal Research book has simple instructions about how to do this and the following. Identify the issue, facts, holding and rationale in the case. Write a sentence of your own, in your own words, which states the issue, and another sentence which explains the holding.
