Craig v. Boren (1976)
|
Details:
In Oklahoma in 1976, "non-intoxicating 3.2% beer was prhibited for sale to males under 21 and females under 18. The law was challenged as gender discrimination by an under-21 male and a store owner who sold alcohol. The defendants submitted statistics showing a disparity between arrests of males and females on alcohol related charges, with the male demographic having significantly more. The Supreme Court found that the data was not sufficient to justify the policy, and that the same prejudices as those behind the policy could be argued to be responsible for the data itself.

Applications and Implications:
- While not an education-related case, Craig v. Boren established the middle-level test (also referred to as the 'substantial relation test') as the standard for gender discrimination cases.
