Details:
A teacher assigning students to groups of four paired black students because she felt that "sometimes it works well if they have someone else [who is black] working with them because they view things in a global manner." The court found that the group assignment did not meet strict scrutiny because it was based upon a stereotypical view of black students rather than on any demonstrable fact.
